The article deals with features of the functioning of the judiciary in the mechanism of division of powers in federal state,
by the example of Germany. In this sphere the author specifically considers the peculiarities of the distribution of
competence between the Federation and the Lands, because it has influence on the efficiency of justice in the country in
tote. On the basis of the Basic Law for the Federal Republic of Germany, the author concludes that in Germany the basic
regulation of the judicial system and legal proceedings are carried out at the federal level, while justice is carried out by
courts of lands.
